The terms & conditions the photographer/videographer shall mean any representative of South West photo & Film. “The client(s)” shall be those persons defined as bride and groom/bride and bride/groom and groom in the wedding booking. It is agreed that the following terms set out the total agreement made between the parties and that no variation or modification of these shall be effective unless agreed by both parties in writing. Any booking whether confirmed verbally, electronically or in writing will be subject to a legally binding contract carrying the following non-negotiable terms and conditions of booking
Booking Fee / Deposit Payments
On completion of booking form and payment, full acceptance of these terms and conditions will be taken.
Your booking secures the time and services of the photographer/videographer for the wedding and is refundable or transferable in the event of cancellation according to the cancellation policy further down on t&c’s.
Wedding Arrangements
The details of the wedding arrangements can be finalised via the wedding booking form and via email/phone conversation or in person. The Client shall notify South West photography & film of any changes to these details in writing. The photographer/videographer/s cannot be held liable for delays or disruption in their delivery of the service until any changes are received, and acknowledged in writing. We aim to deal with the wedding couple with regards to details. If a parent or family member books us on your behalf, we still require to deal with the wedding couple regarding logistics and wedding details.
Cancellation/Postponement
The Client may cancel this contract at any time by giving written notice by post to South West photography & film but in doing so shall forfeit any monies paid according to this cancellation policy:
The amount paid is refundable minus a £125.00 admin fee if cancelled 6 months or more before the date booked, If cancelled between 6 and 2 months prior to the date a charge of 50% will incur, if cancelled within 2 months of the above date no refund will be made. If South West Photography & Film cancel at any point a full refund will be made. The only time we will not make the refund is if we have had to cancel due to late/none payments. If an agreed payment is more than 48hrs late then we have the right to cancel at any point, we will so this in writing by both email and post. If cancelled by you your refund will be made in full after our 60 day cooling-off period (DUE TO COVID-19) from date of the notice.
Covid-19
The client will be offered a free move the date to a new suitable date they provide. We will also offer to hold your booking until a new suitable date is found. If you decide to move to a date where we can not accommodate you the terms and conditions above will be implemented.
Display
The client(s) hereby allows the South West photography & Film to display any images covered by this contract and to generally promote the business in advertising, brochures, magazine articles, websites, social media, blogs sample albums etc. A sneak peek can be posted the same day/or within a matter of days on social media for marketing purposes.
Presentation
All photo/videos will be received on a USB stick and will be provided in full HD. After receiving the photos/video, the clients may have one opportunity only to make any amendments. If any other changes are wanted to be made after this opportunity, a £40 per hourly rate for editing will be charged by South West photography & Film. Once the client is satisfied with their video, all footage other than the final video will be stored by South West photography & Film for 6 months before being permanently deleted.
South West photography & Film aims to have all videos completed and sent back within 6-8 weeks of the wedding day, however, this can not always be possible. In the event that photos/videos elapse the 6-8 weeks period, the company can not be liable.
For a booking involving a church ceremony or at certain venues, the photographer/videographer’s movements are sometimes restricted by the official in charge. The area from which the photographer/videographer is able to cover the ceremony may not be the photographers/videographers’ choice and the photographer/videographer cannot accept responsibility for any obstructed view should this be the case. Occasionally the venue can refuse photography/videography during the ceremony. This is not the responsibility of the photographer/videographer and will be discussed with the couple.
Full wedding videos are additional charges of £75.00 they will not be provided unless booked before your wedding day.
Second photographer/Videographer
When you book, you may opt for a package that includes a second photographer/videographer. Even if you don’t, it may be possible that the photographer/videographer brings a second photographer/videographer or assistant to help capture the day as best as possible and to offer alternative view points of images. Lee Brewer Photography will aim to inform you of this prior to your wedding.
Copyright
The copyright Designs and Patents Acts assign the copyright of the images to South West photography & Film. Any images/videos or copies of images/videos whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow to be copied photographically/electronically or by any other means an image/video created as part of this contract without the permission of South West photography & Film in writing. On completion of payment and services, South West photography & Film grants the License to Print and License of Use fully to the clients. Clients are free to use, copy, share, print without restriction. South West Photography & Film owns all images/videos and has no legal requirement to supply any additional images/videos outside of the agreement, if South West photography & Film wish to share any additional images/videos there will be a charge and it will be at there discretion.
License
The Photographer/videographer/s shall be granted artistic license in relation to the poses captured and the locations used. The photographers/videographers judgement regarding the locations/poses and number of images taken shall be deemed correct. Due to the vagaries of the weather and the willingness of subjects it may not be possible to capture all the images requested.
Force Majeure or Act of God
The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control. Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the Photographer/videographer will not be responsible for any footage/images that are not produced due to technical failure.
Attendance
In the unlikely event of the assigned Photographer/videographer being unable to attend your wedding due to unforeseen circumstances, we reserve the right to appoint another Photographer/videographer to attend your wedding on our behalf to undertake the wedding Photography/videography to his/her best ability.
Limitation of Liability
In the unlikely event of total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.
Personal Accident
Any directions issued to clients, their guests or employees during a video shoot are deemed to be at said persons own risk. The Photographer/videographer cannot be held responsible for any personal accidents during a photo or video shoot of any kind.
Complaints
In the event that you should wish to make a formal complaint, South West Photography and film will only except this is writing to our business address.
Governing Law
This agreement shall be governed in accordance with the laws of England and Wales.
